NSW Balloting and Exemption Conditions Unless otherwise stated in the conditions of the race programme, the following balloting and exemption conditions apply. Effective September 1, 2018 1. GENERAL CONDITIONS * The following balloting conditions (including the determination and order of emergency runners), apply to all races that do not have specific balloting conditions stated in the race programme. Following the sequential application of sub-clauses 1.1,1.2,1.3 and 1.4, if a further ballot is needed, the balloting conditions listed for each race type will then be used. * An indicative list of horses in elimination order for all races falling under these conditions shall be available at weight declaration time. It is important to note that this list is subject to change following the application at acceptance time of some clauses listed below. 1.1 Dual Acceptances (Group 1 races exempt from this clause) 1.1.1 Should a horse be declared an acceptor (and is afforded the opportunity to start) in two or more NSW races on the same day at the same venue, the Stewards may at their discretion ballot such horse from or place as an emergency in, any race for which a ballot is required. If needed, the order of elimination for horses affected under this clause, will be that which the balloting conditions for that type of race dictate – Note: LR42(1) applies to Metropolitan Saturday Races – if a trainer accepts for more than one race on the program, the horse must be withdrawn from all but one race by 5pm acceptance day (except where an emergency) 1.1.2 In the operation of clause 1.1.1, the nominator may indicate any race preference at time of acceptance with the Trainers and Racing Services. For example, conditional acceptance in a second race dependent upon gaining a start in the first race. In all cases the operation and effect of clause 1.1.1 by the Stewards shall be final. 1.2 Exemption for Balloted-Out Horses The following ballot exemptions are not applicable to feature races run at feature meetings. A feature race is determined by advertised prizemoney being above the standard for the sector. The standard prizemoney levels are:- Provincial $35,000 Country $24,000 PLEASE NOTE – There are no ballot exemptions into Metropolitan races unless specified in the conditions of the race. 1.2.1 Provincial area Where a horse has been balloted out of a NSW Metropolitan or Provincial race at acceptance time, or failed to gain a start as an emergency, such horse will be exempt from the ballot for 21 days after the date of the race, provided the exemption only applies to a race of the same type, 2yo’s to 2yo’s (and any other race provided the race is of the same eligibility as the horse) 3yo’s to 3yo’s (and any other race provided the race is of the same eligibility as the horse) Maiden to Maiden Class 1 to Class 1 (Class 1 horses only) Class 2 to Class 2 (Class 2 horses only) A BENCHMARK race where the horse’s benchmark figure is within the benchmark range for the race from which it was balloted and the race in which it is claiming the exemption. For the purposes of this condition, the following benchmark ranges apply: Within 14 points of the Benchmark of the race. Examples as below: BENCHMARK 70 - Benchmark figure 56 and higher BENCHMARK 64 - Benchmark figure 50 and higher The exemption will become null and void should the horse receive the opportunity of a start in any race within the 21 day period. It is the sole responsibility of the nominator to inform the Trainers and Racing Services at nomination time, of any exemption rights a horse may have. The nominator must inform the Trainers and Racing Services of the date and venue from where the exemption is claimed. 1.2.2 Country area Where a horse has been balloted out of any NSW race at acceptance time, or failed to gain a start as an emergency, such horse will be exempt from the ballot for 21 days after the date of the race, provided the exemption only applies to a race of the same type, 2yo’s to 2yo’s (and any other race provided the race is of the same eligibility as the horse) 3yo’s to 3yo’s (and any other race provided the race is of the same eligibility as the horse) Maiden to Maiden (including Class 1 Maiden Plates) Class 1 to Class 1 (Class 1 horses only) Class 2 to Class 2 (Class 2 horses only) Class 3 to Class 3 (Class 3 horses only) A BENCHMARK race where the horse’s benchmark figure is within the benchmark range for the race from which it was balloted and the race in which it is claiming the exemption. For the purposes of this condition, the following benchmark ranges apply: For all races of Benchmark 51 and higher, exemptions apply within 14 points of the Benchmark of the race. Examples as below: BENCHMARK 74 - Benchmark figure 60 and higher BENCHMARK 66 - Benchmark figure 52 and higher BENCHMARK 58 - Benchmark figure 44 and higher For all races of Benchmark 50 and below, eligible horses shall be exempt from ballot irrespective of their Benchmark as there are no restrictions by Benchmark for these races. Example below: BENCHMARK 50 - Benchmark figure between 0 and above The exemption will become null and void should the horse receive the opportunity of a start in any race within the 21 day period. The nominator must inform the Trainers and Racing Services of the date and venue from where the exemption is claimed. 1.3 Preference for original nomina- tions over additional nominations In the event that nominations are extended for a race (as opposed to the race containing a late entry provision or the advertised closing time for nominations being amended), those horses included in the original list of nominations shall receive balloting preference over any additional nominations, unless the additional nomination is in receipt of an exemption in accordance with clause 1.2 above or was nominated as the result of an abandoned race or race meeting. 1.4 Definition of Prizemoney and/or Performances for Balloting purposes 1.4.1 In determining eligibility, weights and/or balloting conditions for any race, no account will be taken of, appearance monies, incentive payments, breeder, trainer or owner bonuses. Further that no account will be taken of any payment which was not available to all horses which were eligible to be nominated for such race (in accordance with LR 26). 1.4.2 The definition of ‘Prizemoney’ includes the value of any advertised ‘Trophies’, however does not include the value of any ‘Stallion service’ 1.4.3 For the purposes of these conditions, any prizemoney and/or performance record shall be that which is available at weight declaration time. 2. HANDICAP EVENTS Metropolitan and Black Type handicap races may be subject to discretionary weight allowances and/or penalties 2.1 Maiden Handicaps and any 2yo’s Handicap race In determining the ballot order for maiden handicaps, an age/sex balloting penalty may be added to a horse’s weight for balloting purposes. This is used to redress any disadvantage that a female or young horse may suffer in balloting against its male or older opponents by virtue of it having a lower starting weight.
