NEW RULE AMENDMENTS Amend TOR Rule 6 as follows: TOR Rule 6 – Consequences if the presumption of a training debt arises (6) Subject to subrule (7), if an EAA has been applied by Racing Australia and/ or a PRA against an owner under this rule, while that EAA remains in place: (a) that owner must not, either directly or indirectly, acquire an interest in another horse and/or lodge with Racing Australia or a PRA in respect of another horse: (i) a Foal Ownership Declaration; (ii) a registration application; (iii) a transfer of ownership application, except for the purpose of that owner selling his or her interest in another horse; or (iv) a lease application; and (b) Racing Australia and/or a PRA must not process any such application or lodgment. (7) Racing Australia and/or a PRA (as applicable) may waive any prohibitions in subrule (6) if they are of the opinion that such waiver will assist in reducing the relevant owner’s training fees and/or training disbursements debt. Date of effect: 1 August 2021 PREVIOUSLY PUBLISHED RULE AMENDMENTS Notice of Amendments to Co-Owner Agreement (COA) Clause 1.1 & 1.2 – To identify the effective date (1 August 2018) of the revised COA. Clause 3.6(d ) – Proviso that where owners with 50% ownership of a horse wish to accept a trainer’s fees notice, and owners with the other 50% ownership wish to object to the fees notice, the managing owner must object on behalf of the owners. Clause 4.3 – To clarify the sale process where an owner wants to sell only their interest in the horse, as opposed to where the ownership group (with majority consent) wants to sell the whole horse. The revised COA is available at www.racingaustralia.horse Date of effect: 1 August 2018 Notice of Amendments to Standard Training Agreement (STA) Clause 1.1 – To identify the effective date (1 August 2018) of the revised STA. * Clause 3.1 & 3.3 – For consistency with amendments to TOR Rule 3 (effective 1 August 2018). Clause 8.1(d) – A trainer’s right to retain horse identification documents only applies where the defaulting owner/s has an interest in more than 50% of the horse (but does not apply to the thoroughbred identification card). Clause 8.1(h) – A trainer’s right to sell a defaulting owner’s interest in a horse is only permitted where: (a) the trainer has filed a valid Enforcement Action Application with Racing Australia; or (b) a Training Disputes Tribunal has made an order in favour of the trainer but the owner has not complied with that order. Clause 8.2 – A trainer’s right to sell a defaulting owner’s interest in a horse ceases if payment of the outstanding debt is made during the notice period. If the interest is not sold within 60 days of being offered for sale, the trainer must comply with the notice/sale process again. Clause 14 – New provision that requires a trainer and owner/s to attempt to resolve, including through mediation, any disputes not concerning payment (i.e. which are not covered by the TOR) before commencing legal proceedings. All prizemoney paid will be issued a Recipient Created Tax Invoice (RCTI) Visit our website at www.racingnsw.com.au to download copies of all forms including bank details, GST declaration and to access your Stakes Payment Account Online. Exception: The exception to the above dates is when payments for winning owners prizemoney is subject to swab clearance. Please note Racing NSW reserves the right to change payment dates without further notice must wear: (a) a safety vest that complies with the requirements in subrule (1); and (b) over that safety vest, or over clothing worn over that safety vest, a harness or braces that contains safety warning lights of a type approved by Racing Australia, a PRA or the Stewards. (5) Subrule (4) does not: (a) apply to any rider who complies with AR 122(6); (b) apply to any location where the Stewards have ruled that sufficient artificial lighting exists; (c) affect the requirement that trackwork may only be conducted where Stewards have ruled that sufficient natural or artificial lighting exists. (6) If an apprentice jockey breaches subrule (1), the apprentice jockey’s master and/or any other person who was in charge of the apprentice jockey at any relevant time may also be penalised unless that person satisfies the Stewards that he or she took all proper care to ensure that the apprentice jockey complied with that subrule. Date of effect: 1 February 2021 Amend AR 241 as follows: AR 241 Prohibited substance in sample taken from horse at trial etc If a horse is brought to a racecourse or recognised training track to participate in: (a) an official trial; (b) a jump-out for the purpose of obtaining a permit to start in a race (whether after suspension or otherwise); or (c) any other test for the purpose of obtaining a permit to start in a race (whether after suspension or otherwise), and a prohibited substance on Prohibited List A and/or Prohibited List B is detected in a sample taken from the horse prior to or following the relevant event, the trainer and any other person who was in charge of the horse at any relevant time breaches these Australian Rules.
