Satisfactory and current public liability and personal accident insurance is a requirement to be eligible to be licensed as a trainer. The group public liability/professional insurance policy and the personal accident insurance policy for NSW trainers for 2020/21 was successfully negotiated by the NSW Trainers Association on behalf of the majority of NSW Licensed Trainers. Over 98% of licensed Trainers are covered by the policies as effected by Gow-Gates Insurance Brokers (Australia) Pty Ltd on behalf of the NSWTA for the 12-month period 1 August 2020 to 31 July 2021. The insurance fees are charged as follows: - Public liability/Professional indemnity insurance: • NSW Trainers pay a base fee of $363 (inc GST) with their license renewal (Owner Trainers $242), then an activity fee per starter, as negotiated by the NSWTA. This method of fee collection will assist trainers' cash-flows by having a pay-as-you-go charge. The fee per starter is: • Race Starter - $1.54 (inc GST) • Barrier Trial Starter - $1.54 (inc GST) Personal Accident insurance The fee per month is: • $30.41 per trainer (inc GST) Policy information will be forwarded to all covered Trainers by the NSWTA, or to view a copy of the policies see the NSW Trainers Association website www.homeofracing.com.au/trainers-lounge/ or see www.gowgatessport.com.au (Gow-Gates Pty Ltd, are Insurance brokers for the NSWTA). Note: Racing NSW assists the NSWTA by collecting the premium for Public Liability Insurance and Personal Accident Insurance on their behalf. The policies are with third party insurers and should not be confused with the Workers Compensation Fund which is managed by Racing NSW (workers compensation insurance is also a requirement to be licensed). Those trainers not under the NSWTA PLI / PI or PA cover have made their own arrangements for insurance and are not part of the base fee/per starter or monthly collection process. Trainers – Public Liability/Professional Indemnity and Personal Accident Insurance [2020-2021] abide by these conditions if granted a licence. Interstate visitors please note: The provisions of Local Rule 56 will apply to any person holding a Dual Licence issued by another Principal Racing Authority, while participating in NSW. MINIMUM WAGES FOR APPRENTICE JOCKEYS Due to a decision by the Fair Work Commission of Australia to insert Apprentice Jockey Wage Rates into the Horse and Greyhound Training Award 2010 , Apprentice Jockey wages changed to a new Australia-wide award from 10 November 2014 . This new wage scale applies nationally, and provides different rates of pay for Apprentices who have completed Year 12, and also includes an FWC decision that recognises a higher wage for Adult Apprentices (age 21yrs plus) who commenced their apprenticeship after 1 January 2014 and were 21yrs+ at the time of commencement. To view the notice issued by Racing NSW about the decision and the new wages, please refer to the Jockeys Room section of the Racing NSW website, sub heading Apprentices Superannuation Employers must by law pay superannuation at the rate of 9.5% of gross wages into an approved Superannuation fund. Within 28 days of commencement of employment, employees should be issued a “Choice of superannuation fund standard choice form”. This allows the employee to choose an eligible fund. Forms can be downloaded from the Australian Tax Office website (www. ato.gov.au or order hard copies by phoning the ATO’s publications ordering service on 1300 720 092 (and quoting NAT Number 13080). Additional voluntary superannuation contributions may be made by the employee up to an age based limit. Apprentices may like to contact the NSW Jockeys Association for further information about Superannuation options. Wages – make payment by direct deposit It is a requirement that apprentice wages are paid directly into the Apprentice’s nominated Bank Account. This is usually by way of Electronic Funds Transfer (EFT), or direct cash deposit at the bank, or by Direct Debit. Trainers’ who may be unfamiliar with the process of making payments by EFT or Direct Debit, please make contact with your bank, Racing NSW or NSWTA to seek relevant advice. Payslips Trainers are required to issue payslips to Apprentice Jockeys (and all employees) within one day of the employee being paid. Payslips should itemise the correct pay and entitlements for staff according to their respective Award. RACING NSW ‘RISING STAR' APPRENTICE RACE SERIES The Series is open to NSW and ACT indentured apprentice riders who are enrolled at Racing NSW Apprentice Schools. Preference will be given to apprentice riders who, in order: (i) fulfil the requirements of the NSW Apprentice and Traineeship Act of 2001. (ii) are on loan from another state (for longer than two months) and who have been placed with the trainer of a horse nominated in a heat. (iii) are visiting from another county and do not fit the requirements of Part (i). Unless riders fulfil the requirements from category (i) they will be unable to ride in the Final. Riders from Category (ii) and (iii) may ride in a heat, but may not attain points, or ride in the Final. Individual awards for heats shall be made to the highest placed rider from Category (i). In the event that there are insufficient qualified apprentice riders available on the day of a series race, after confirmation from the Racing NSW Training Dept, Stewards may permit an Interstate Apprentice Jockey who does not qualify under Category (ii) to ride. These riders may not attain points or ride in the final. The Rising Star Racing Colours will be carried by the apprentice leading the series at the time the heat is run, or if the leading rider is not competing, the topweight will carry the colours. Points will be awarded for each race on the following basis: (i) First Place - 7 points; Second Place - 5 points; Third Place - 3 points; Fourth Place – 2 points; All other placings - 1 point (ii) In the case of a dead heat, the effected placing's points shall be added together then divided by the number of dead heaters. (iii) If an apprentice is declared for a ride and the horse is subsequently scratched, the apprentice will gain one point. Apprentices who are due to come out of their time during the period of the Rising Star series will be eligible to compete until such time as their apprenticeship finishes. These apprentices will also be eligible to become the overall Rising Star Series winner, with points earned in the races in which they are eligible to ride to be considered in the final tally. All heats and the Final will be restricted to 12 riders. Racing NSW can amend the Rising Star Series Conditions at any time, to ensure equal opportunity for all participants. The Final The last race in the series shall be the Rising Star Final (“the Final”) Final Race Conditions 1) The final is restricted to NSW and ACT apprentices who have earned points during the running of the Rising Star series 2) Finalists amassing the highest number of points in the Heats shall be first available for rides in the Final. In the event that any apprentice who is eligible to compete in the Final is unable to ride through injury, suspension or other- wise, additional riders are the next NSW riders in line on the points table 3) At the conclusion of the Final heat, Racing NSW shall publish the list of riders for the Final in order of points accrued. All finalists must declare a riding weight prior to this list being published, 4) Finalists mounts are to be determined by lot at acceptance time. 5) A ballot will then be determined for finalists rides in the Final as per riding weight. i. Finalists must claim down to their declared riding weight. (Overweights are not to be permitted unless authorised by the Stewards and confirmed with connections of the horse concerned). (ii) The ultimate decision regarding riders competing in the Final rests with Racing NSW Officials and Stewards, who will firstly consult with Trainers affected. (iii) At the conclusion of the Final, the apprentice who has accumulated the most points in the series including the Final will receive the Rising Star Cup. (iv) In the event of more than one rider finishing on equal points after the Final, a count-back will occur. The Apprentice with the most race wins, and subsequently the most 2nds then 3rds within the series will be declared the outright winner. TREATMENT ON COURSE All treatments on race day including glycerine, Vicks vapour rub, magnetic field therapy blankets and lasers are not permitted. The use of ice packs is permissible after a horse has raced provided notice is given to the Official Veterinarian or Stipendiary Stewards. HEART RATE METERS Trainers wishing to utilise heart-rate meters or other cardio-respiratory monitoring devices, with or without radiotelemetry, during the training of horses at a registered racetrack or registered training track are required to: 1. Seek written permission from the Stewards to do so. 2. Submit the apparatus to the Stewards for inspection by the Racing NSW’s Official Veterinary Surgeons. 3. Notify the names of horses on which the apparatus is to be used. 4. Notify the Steward attending track work or the track Official when the horse on which the apparatus is fitted is to work.
